Dispute Resolution
We aim to resolve your disputes and aim to
bring a successful conclusion.
Unfortunately disputes can arise in many aspects of everyday life. We, at Broomfields, aim to
help to resolve all kinds of dispute for all our clients to avoid what can start as a minor dispute
escalating further. We will identify, analyse and minimise risk by advising on the best route at the
earliest possible stage to avoid the unnecessary conflict which can arise.
We will always give you clear and pragmatic advice which is tailored to the situation you are in.
Our aim is not only to solve the immediate dispute but also to address any wider issues that
you may face going forward.
We want you to be able to make an informed decision about your strategy and goals from the
outset. We will provide realistic advice on the options available to resolve matters, either through
mediation, arbitration, negotiation or litigation. We then pursue the appropriate course of action
to resolve your dispute in the most cost-effective way. Wherever possible, we avoid the disruption and
costs of litigation by encouraging parties to mediate or negotiate a settlement before the case
reaches court.
We aim to resolve your disputes and bring them to a successful conclusion but, when required, our
services extend to providing full representation in the courts and tribunals. Our firm has the experience
and expertise to deal with resolving most of the common areas for disputes and access to specialist
help and assistance, where required.
The main areas where we provide assistance and legal advice are:
Boundary/Property and Land disputes
Commercial disputes
Contractural disputes
Professional Negligence
Claims on the estate of someone who has passed away
Landlord and Tenant Disputes
Employment Settlement Agreements

Dealing with the estate of someone who has died can be stressful and time
consuming. We aim to work with the executors and beneficiaries to deal with
the administration in a sensitive yet efficient manner and to remove some of
the burden. If there are any business or agricultural assets involved, we can
provide specialist advice in order to minimise tax liabilities and
business disruption.

Wills and Power of Attorney
Everyone should make a Will…
It is important that you make a will to ensure that your money and possessions are distributed
according to your wishes. Writing a will makes it easier for your family or friends to sort everything
out when you die – without a will the process can be time consuming and stressful. A will can also
help reduce the amount of Inheritance Tax that might be payable on the value of your assets. We can
provide options to protect vulnerable beneficiaries and potentially safeguard some of your assets
against care home fees.
We can also advise on the benefits of making Lasting Powers of Attorney (LPAs). Mental and physical
incapacity can hit at any time, which is why we recommend planning ahead to ease the potential
burden on loved ones. A lasting power of attorney transfers authority to look after specific aspects of
your financial affairs or health and welfare should you lose the capacity to do so. It’s not just for the
elderly; younger people may become incapacitated through accident or illness.
If you do not have an LPA in place and later become mentally incapacitated, relatives may face long
delays and expense in applying to the court of protection to get access and take control of your assets
and finances. We provide friendly, sensible and impartial advice and offer a competitively priced service.
